Terms of Service

1. Acceptance of Terms

By accessing or using SceneSwap AI (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We reserve the right to modify these Terms at any time; continued use after changes constitutes acceptance.

2. Eligibility

You must be at least 13 years old (or 16 in the EU) to use the Service. By using the Service, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Subscriptions and Billing

The Service offers three subscription tiers: Free, Pro ($19/month or $190/year), and Premium ($79/month or $790/year). Subscriptions are billed in advance on a monthly or annual basis.

  • Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date.
  • You may cancel your subscription at any time via your account dashboard or the Stripe customer portal.
  • Refunds are issued at our discretion. Contact support within 7 days of a charge for refund consideration.
  • We reserve the right to change pricing with 30 days' notice to existing subscribers.

4. Acceptable Use

You agree NOT to use the Service to:

  • Create content that depicts real, identifiable individuals without their explicit written consent.
  • Generate content that is defamatory, harassing, threatening, obscene, or otherwise unlawful.
  • Produce non-consensual intimate imagery (NCII) or any content that sexualizes minors.
  • Impersonate public figures, celebrities, or any person in a misleading or harmful way.
  • Circumvent subscription limits, reverse-engineer the Service, or scrape our APIs.
  • Distribute generated content in a way that falsely implies it depicts real events.

Violation of these rules may result in immediate account termination without refund and, where applicable, referral to law enforcement.

5. Responsible Use of AI

SceneSwap AI generates synthetic media. You are solely responsible for how you use, share, or publish generated content. You must clearly disclose that content is AI-generated when sharing it publicly, in accordance with applicable platform policies and laws (including the EU AI Act and any applicable deepfake disclosure laws in your jurisdiction).

6. Intellectual Property

You retain ownership of the original photos and audio samples you upload. By uploading content, you grant SceneSwap AI a limited, non-exclusive license to process that content solely for the purpose of generating your requested output. All scene templates, AI models, and platform infrastructure are the exclusive property of SceneSwap AI.

7. Generated Content License

You own the generated videos produced from your account. We grant you a non-exclusive, worldwide license to use, share, and publish your generated content for personal and commercial purposes, subject to these Terms. We may use anonymized, aggregated generation data to improve our AI models.

8. Disclaimers and Limitation of Liability

The Service is provided "as is" without warranties of any kind. We do not guarantee that AI-generated content will meet your expectations, be error-free, or be available without interruption. To the maximum extent permitted by law, SceneSwap AI's total liability for any claim arising from use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, with or without notice. You may terminate your account at any time by contacting support. Upon termination, your right to use the Service ceases immediately.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved by binding arbitration under the AAA Consumer Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction.
